Tom Ngeri

Overview

Tom is the Senior Partner in the Firm. He holds a Bachelor of Laws (LL.B.) Degree from the University of Nairobi, a Master of Laws (LL.M.) Degree from the University of Dar es Salaam and has also received training in the Federal Republic of Germany and Belgium. Tom is also a Patent Agent with a keen interest in Intellectual Property law and has advised and acted for various clients at both ARIPO and WIPO offices.

Tom has a sharp legal mind and is reputed for keenness and efficiency in his solution-oriented practice. He has advised and acted for clients in various areas of the Law including but not limited to Structured Financing, Real Estate, Banking & Finance, Dispute Resolution, Corporate & Commercial Law, Project Finance, Asset Securitization, Policy & Legislative Drafting, Construction Law, Intellectual Property Law, Joint Ventures, Mergers & Acquisitions and Regional Integration Law.

He has advised Banks, State Corporations, National & County Governments and Multinationals and has engaged in numerous cross-border transactions and advisories within the East African Community (Tanzania, Rwanda, Burundi, South Sudan and Uganda), the African Continent (Ghana, Nigeria, Ethiopia, South Africa, Zimbabwe, Senegal) and beyond (China, India, Mauritius, Canada, Thailand and the United States of America). This exposure on the world stage has given Tom a unique level of experience that is always a welcome boost to the Firm in its drive towards globalization

Besides practice, Tom is also a Senior Lecturer of Law and an Academic Head of Private Law Department at the Catholic University of Eastern Africa, a Private University in Kenya with a presence across eleven (11) African countries.

  • Acted for Stanbic Bank of Kenya Limited in a take-over of banking facilities for the cumulative sum of Kenya Shillings Fourteen Billion Three Hundred and Seventy-Nine Million (KShs 14,379,000,000)
  • Currently involved in representing KCB Bank Tanzania Limited in pursuing the defaulted loan amount of United States Dollars Eleven Million Only (USD 11,000,000) to Nakumatt Tanzania Limited which was guaranteed by Nakumatt Holdings Limited (under Administration)
  • Acted for KCB Bank Kenya Limited in a transaction concerning the perfection of securities in favor of KCB Bank Kenya Limited for Kenya Shillings Three Billion Only (KShs 3,000,000,000)
  • Acted for Barclays Bank of Kenya Limited in a transaction concerning the perfection of securities in favor of Barclays for United States Dollars One Hundred Million (USD 100,000,000)
  • He advised and acted for a Client in the protection of Patent and Petty Patents (or Utility Model) in Kenya, Uganda, Rwanda and Tanzania, Zimbabwe and Mozambique.
  • Was part of the team together with my Bush Wanjala and Herman Omiti who advised the Pharmacy and Poisons Board on the drafting of the Regulations for Parallel Importation of Drugs in Kenya.
  • Advised the Lake Basin Development Authority on the tripartite dispute between itself and the Financier and Developer concerning the construction of the Lake Basin Mall.
