Collins Bush Wanjala

Overview

Collins is the Managing Partner and Head of the Corporate & Commercial Department in the Firm. He holds a Bachelor of Laws (LL.B.) Degree from Kenyatta University. Bush has also received training in Legal & Governance Compliance Audit from the Kenya School of Law.

He has extensive experience in advising clients on Corporate and Commercial transactional matters. His practice extends to Private Equity, Buy-Outs & Investments Transactions, Project Financing, Telecommunications, Media Technology, e-Commerce, Tax Law, Employment & Labor Relations, General Corporate Commercial Practice, Dispute Resolution, Public-Private Partnership, Joint Ventures, Mergers & Acquisition, Intellectual Property, Banking & Insurance, Mining, Oil and Gas Practice, Institutional Legal Audits, Projects & Infrastructure, Immigration Law, Capital Markets and Securities Law.

He is dynamic in his approach to legal practice and comes in handy whenever any new area of law comes into play. His fine attention to detail makes him an asset to our international practice. Bush has advised and acted for clients in the East African Community region (Tanzania, Uganda, South Sudan, Burundi), within the African Continent (South Africa, Zimbabwe, Nigeria, Ethiopia and Senegal) and beyond Africa (Turkey, China, India, Canada and Mauritius). Collins has also been involved in advising a client on renewable energy and the necessary legal framework for the establishment of Nuclear Power Plants in Kenya.

  • Has advised numerous Clients on registration of IP related rights in Kenya, regionally and internationally.
  • Advised and acted for an Indian Company in relation to obtaining mining licenses within the Country.
  • Advised the Lake Basin Development Authority on the tripartite dispute between itself and the Financier and Developer concerning the construction of the Lake Basin Mall.
  • Was part of the team, together with international consultants, who advised the Kenya Nuclear Electricity Board (KNEB) on the requisite legal structure to support the installation of Nuclear Power Plants in Kenya and the use of Nuclear Energy as a source of Energy.
  • Was part of the team together with my Partners, Tom Ngeri and Herman Omiti who advised Pharmacy and Poisons Board on the drafting of the Regulations for Parallel Importation of Drugs in Kenya.
  • Participated as Assisting Counsel for the IEBC team in the two Presidential Election Petitions for the 2017 Presidential Elections.
  • Represented Hausraum Limited in a contractual dispute worth over Kenya Shillings Six Billion that proceeded to Arbitration and partly undertaken in Court.
  • Was the Lead Counsel for and successfully represented the IEBC in the Election Petition against the election of the Governor, Laikipia County both in the High Court and Court of Appeal.
  • Conducted a Legal Compliance Audit on the University of Eldoret in relation to its compliance to existing laws and policies as well as its compliance to the statutory obligations contained in the Performance Contract between the Government of Kenya through the Ministry of Education, Science and Technology and the University.
  • Advised the KCB Bank Kenya Limited in relation to its securities relating to the loan facilities granted to Turbo Highways Limited against which insolvency proceedings had been instituted. He also successfully represented KCB in the Insolvency Petition against Turbo Highways Limited whereupon it was able to recover its securities of well over Kenya Shillings Two Hundred Million.
  • Successfully represented Kobby Technologies in a Public Procurement dispute against the National Treasury for a value of Kenya Shillings Two Hundred and Forty-Three Million Nine Hundred and Twelve Thousand (KShs 243,912,000)
